Liquidated Damages Clause
- Liquidated Damages Clause is a legal term for a relatively simple principle
- Driving Instructor Trainers provides training to help a potential driving instructor to qualify as a DVSA ADI, without having to pay the full cost of training
- In return, the potential driving instructor will commit to working under a franchise agreement with Birmingham Driving School, or one of our other sister companies
- If the driving instructor does not continue to work with Birmingham Driving School
- The full cost of all the training provided is payable immediately
- This will be calculated at our normal rate for individual training sessions, currently £150 for a 3 hour training session
- The amount payable under this clause will reduce based on the time that the driving instructor continues to work as a franchisee with Birmingham Driving School
- It is not the intention of Driving Instructor Trainers to impose a penalty on the trainee / driving instructor, but it is necessary, that where appropriate the loss of fees for training that would normally be paid are recovered
- A contract will detail the responsibilities of both the trainee / driving instructor and Driving Instructor Trainers including the terms of the Liquidated Damages Clause
